Terms of Service

1. Acceptance of Terms

By accessing or using Apex AI ("the Platform"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

Apex AI provides an AI-powered platform for product development teams, including product management, design, development, QA, and DevOps tools. The Platform orchestrates AI agents across your existing workflow using connectors to third-party services.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Subscription and Billing

Apex AI offers subscription plans (Team, Business, Enterprise) with monthly billing. Prices are subject to change with 30 days notice. Additional seats are billed pro-rata. You can cancel at any time; your access continues until the end of the billing period.

5. Bring Your Own AI (BYOAI)

You are responsible for your own AI provider accounts, API keys, and associated costs. Apex AI is not liable for charges incurred through your connected AI providers. You must comply with each provider's terms of service.

6. Data Ownership

You retain ownership of all data you input into the Platform. Apex AI does not claim ownership of your code, designs, specifications, or any other content processed through the Platform.

7. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Attempt to circumvent usage limits or security measures
  • Reverse engineer or decompile the Platform
  • Resell or redistribute access without authorization
  • Use the Platform to develop competing products

8. Service Level Agreement

Enterprise customers receive a custom SLA with guaranteed uptime (up to 99.99%). Team and Business plans target 99.9% uptime but do not include a formal SLA. Scheduled maintenance windows are communicated in advance.

9. Limitation of Liability

Apex AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access if you violate these Terms. Upon termination, you can export your data within 30 days. After that period, your data will be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days in advance.
